This “Privacy Policy” governs the use of information by Panacea Bizmart Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at F-24, First Floor, Block D 242, Sector 63, Noida 201301 (hereinafter referred to as “Timaya's”, Timayas.com, “we” or “us”) that is obtained through the use of its website https://timayas.com (“Website”) by the users.

3.2 Financial Information - We do not collect payment card (credit/debit/prepaid/other) details. Our payment happens through a renowned and widely accepted payment gateway. Our payment gateway partner provide us details like mode of payment, transaction details along with date & time and the bank used. We may use this information to provide targeted discounts and promotions.

Timaya's will still contact you when there are changes to the Terms of Service or Submitter Terms of Service, as applicable. 4.3 External Links - Although Timaya's only includes verified links on the Website still Timaya's does not take guarantee for the quality of the links. Users are advised to exercise caution while clicking on any links. Timaya's cannot be held liable/responsible for any damage caused due to external links.

We may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. It is in User’s interest as well as in Timaya's objective, to have accurate, current and complete data concerning users and their account. 7. FORCE MAJEURE
Notwithstanding anything contained in this Policy or terms of use or other terms and condition on the Website or elsewhere, Timaya's shall not be held responsible for any loss, damage or misuse of your personal data, if such loss, damage or misuse is attributable to a Force Majeure Event (as mentioned below).
7.1 ‘Force Majeure Event’ shall mean any event that is beyond the reasonable control of Timaya's and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer, computer system or computer network, computer crashes, breach of security and encryption (provided beyond reasonable control of Timaya's), power or electricity failure or unavailability of adequate power or electricity.
7.2 While Timaya's will endeavour to take all reasonable and appropriate steps to keep secure any personal data which we hold about users and prevent unauthorized access, users acknowledge that the internet or computer networks are not fully secure and that Timaya's cannot provide any absolute assurance regarding the security of users personal data.
8. GRIEVANCE OFFICER
This page is published and shall be construed in accordance with the provisions of Rule 3(11) of the Information Technology (Intermediaries Guidelines) Rules, 2011 (“IT Rules”) that requires publishing the name of the Grievance Officer and his/her contact details on the website, such that users or any victim who suffers as a result of a violation of Rule 3 (outlined in our Privacy Policy and Terms of Use) by any other person, can notify their complaints to us.
Further, as per Rule 3(4) of the IT Rules, the Grievance Officer shall acknowledge or respond to Your communication of violation of Rule 3, by any other person, within 36 (thirty six) hours, and the complaints shall be redressed within 1 (one) month from the date of receipt of the complaint.

9. ARBITRATION
Any dispute arising out of or relating to this Agreement, or the breach thereof, whether occurring while this Agreement is in effect or thereafter, shall be submitted exclusively to binding arbitration conducted in accordance with the provisions of the (Indian) Arbitration and Conciliation Act, 1996. The arbitration proceedings shall take place at Noida, India and in the English language.
10. GOVERNING LAW AND JURISDICTION
This Agreement shall be construed in accordance with the applicable laws of the Republic of India. The parties consent to the exclusive jurisdiction and venue of the courts in the city of Noida, India.
